Delaware and New Jersey lawmakers are pushing forward with legislation to ban cryptocurrency ATMs entirely, joining an extremely limited group of states that have imposed such restrictions.
The two states advanced bills that would prohibit crypto ATMs from operating within their borders. Only three U.S. states currently enforce complete crypto ATM bans, making this a rare regulatory stance at the state level.
The push reflects growing concerns among state regulators about crypto ATMs facilitating illicit activity, money laundering, and fraud. Crypto ATMs operate with minimal oversight compared to traditional financial institutions. They enable quick conversion between fiat and digital assets without robust identity verification or transaction monitoring in many cases.
Delaware and New Jersey lawmakers view blanket prohibition as the most straightforward consumer protection approach. The bills target machines that allow users to buy or sell cryptocurrency using cash or card payments.
Industry observers note the regulatory friction. Crypto ATM operators argue the machines serve legitimate users seeking convenient access to digital assets. They contend that banning the technology entirely prevents responsible adoption rather than addressing bad actors specifically.
The legislative momentum in these two states reflects broader state-level fragmentation on crypto regulation. While some jurisdictions embrace crypto infrastructure, others tighten restrictions. This patchwork creates compliance challenges for operators and pushes users toward less regulated alternatives.
Delaware historically attracts crypto and fintech companies with business-friendly policies, making its crypto ATM ban a notable shift. New Jersey's similar action suggests growing state-level consensus on viewing unregulated crypto ATMs as a regulatory concern outweighing their utility.
The bills still require final legislative approval and gubernatorial signatures to become law. If both states pass their measures, it would expand the list of states with complete crypto ATM bans to five.
